One Person Killed in New Braunfels Car Crash

Posted on in Car Wrecks

New Braunfels car accident lawyerA rear-end accident that should have resulted in minor injuries created a domino effect of events that left one woman dead, according to a recent news report. New Braunfels law enforcement officials asserted that one of the drivers involved in a minor rear-end collision attempted to flee the scene of the accident after the initial collision. The fleeing driver reportedly crossed the center line into oncoming traffic causing a nearly-head-on crash with another car, killing the other driver. The driver attempting to flee the scene suffered critical injuries.

Fatal Car Accidents

While injuries from car accidents can result in minor bumps and bruises, some car accidents result in death. As many as 80 people are killed every day on American roadways, according to the National Highway Traffic Safety Administration (NHTSA). Recent data collected by the NHTSA has found that traffic-related deaths across the nation have increased 7.7 percent in 2015 when compared to previous years. Over 35,000 people were killed in car accidents in 2015, an increase from the approximately 32,600 reported deaths in 2014.

Although the data is still preliminary, the NHTSA estimates show that nine out of 10 regions in the United States experienced an increase in car accident-related fatalities, particularly pedestrians and bicyclists. In non-fatal car accidents, physical injuries can be temporary or permanent and often include mental health issues. Common injuries may include whiplash, disc bulges or herniation, broken bones, and traumatic brain injury, among countless others.

Texas is an At Fault State

In the U.S., laws vary depending on the jurisdiction; state insurance law, which governs car accidents, is no exception. Generally, states are divided up into two types of insurance law: at-fault and no-fault. Like a majority of states across the nation, Texas is an at-fault state. This means that those seeking to recover damages for personal injuries relating to a car accident must establish who is at fault for the damages. Typically, payment is made through each party’s insurance company and damages that are covered by monetary compensation usually include the cost of medical bills, lost past and future wages, property damage, and other injuries.

As an at-fault state, Texas law requires each driver to carry at least a state-mandated minimum insurance coverage. The legal requirements are $30,000 for each injured person, up to $60,000 per accident, and $25,000 for property damage, per accident.
