One Killed, Another Injured in August San Antonio Crash

 Posted on September 16,2016 in Uncategorized

Toward the end of August, one individual died and another individual was injured during a rollover crash with another vehicle on Wurzbach Parkway in San Antonio, Texas. One woman was reported to be in critical condition immediately following the accident but later died in the hospital. The other individual, a 28-year-old man driving the car, was thrown from the vehicle despite wearing his seatbelt. The individuals in the other car that was hit were treated at the scene.

The details of what went wrong are unclear, but accidents such as this one often lead to personal injury or wrongful death claims against the at-fault driver.

Texas Personal Injury Claims

If you were hurt in an auto accident that was caused by another person, you have the right to recover for your injuries. All motorists, cyclists, and pedestrians on the road have a duty of care toward one another. This means everyone must behave reasonably and safely to avoid causing anyone else harm. When people speed, swerve, fail to use their signals, and drink and drive, they are breaching this duty to others because they increase the risk of an accident.

After being injured in an accident, Texas law allows you to seek damages including lost wages, medical expenses, and pain and suffering from the person at fault.

When You Might Need to Go to Court

Many people recover a settlement from an auto insurer after a car accident. Because Texas is an at-fault state, the person injured files a claim with the insurance company of the person or business at fault for the accident. However, insurance settlements don’t work out for many reasons.

Some of the reasons you may have to head to court with a personal injury claim include:

  • The other driver lacks insurance;
  • The other driver let the insurance policy lapse;
  • The policy limit does not cover your damages;
  • The insurance company believes their client was not at fault;
  • The insurance company claims you did not provide proper notice; or
  • The insurance company is participating in deceptive or unfair practices.

There are many legitimate reasons an insurance company at first denies a claim. However, there are ways to overcome an initial denial. There are also ways to recover damages even when an insurer is acting unfairly or illegally. By working with an experienced personal injury attorney, you can be sure the insurance company upholds its policy and treats you justly.
